Rule 4765-24-07 | Reinstatement of an expired or voluntarily surrendered fire charter or classification.

(A) A fire charter or classification that has expired or was voluntarily surrendered shall be reinstated by the executive director, if all of the following apply:

(1) A completed "Fire Charter Application" is submitted to the division no later than three years after the charter expired or was voluntarily surrendered;

(2) The application must indicate it is a request for reinstatement;

(3) The applicant is in compliance with the requirements of section 4765.55 of the Revised Code and rules 4765-24-02 to 4765-24-03 of the Administrative Code;

(4) At the time the charter or classification expired or was voluntarily surrendered, the charter was in compliance with the requirements of section 4765.55 of the Revised Code and rules 4765-24-02 to 4765-24-03 of the Administrative Code, was in good standing, and was not under investigation or disciplinary action for any violations of this chapter.

(B) The division shall review all records and documents related to the cycle in which the charter expired or was voluntarily surrendered and the previous charter cycle. Failure to permit access to requested records and documents may result in denial of the application.

(C) An applicant whose charter or classification expired or was voluntarily surrendered within the time period for reinstatement is not eligible for a new certificate under rule 4765-24-02 of the Administrative Code.
