(A) Music therapy means the clinical use
of music interventions to accomplish individualized goals within a therapeutic
relationship through an individualized music therapy treatment plan developed
for a client. Music therapy interventions include, but are not limited to:
improvisation, receptive music listening, song writing, lyric discussion, music
and imagery, singing, performance, learning through music, music combined with
other arts, music-assisted relaxation, music-based patient education,
electronic music technology, adapted music intervention, and movement to
music.
(B) Music therapy services means the
services a licensee is authorized to provide to achieve the goals of music
therapy, which may include, but are not limited to: accepting referrals for
music therapy services, conducting a music therapy assessment, developing and
implementing an individualized music therapy treatment plan, evaluating and
documenting client responses to music therapy, and utilizing appropriate
knowledge and skills to inform practice.
(C) The practice of music therapy does
not include the screening, diagnosis, or assessment of any physical, mental,
emotional, or communication disorder.
(D) A licensed professional music
therapist will collaborate in the provision of music therapy and music therapy
services.
(1) Before a licensed
professional music therapist provides music therapy services to a client for an
identified clinical or developmental need, the licensee shall review, as
appropriate, the client's diagnosis, treatment needs, and treatment plan
with the health care providers involved in the client's care. Before a
licensed professional music therapist provides music therapy services to a
student for an identified educational need in a special education setting, the
licensee shall review with the individualized family service plan team or
individualized education program team the student's diagnosis, treatment
needs, and treatment plan.
(2) During the provision
of music therapy services to a client, the licensed professional music
therapist shall collaborate, as applicable, with the client's treatment
team, including the client's physician, professional licensed under
Chapter 4757. of the Revised Code, psychologist, or other appropriately
licensed healthcare professional. During the provision of music therapy
services to a client with a communication disorder, the licensed professional
music therapist shall collaborate and discuss the music therapy treatment plan
with the client's audiologist or speech-language pathologist so that a
music therapist may work with the client and address communication
skills.
(3) When providing
educational or health care services, a licensed professional music therapist
may not replace the services provided by an audiologist or a speech-language
pathologist. Unless authorized to practice speech-language pathology, music
therapists may not evaluate, examine, instruct, or counsel on speech, language,
communication, and swallowing disorders and conditions. An individual licensed
as a professional music therapist may not represent to the public that the
individual is authorized to treat a communication disorder. This does not
prohibit an individual licensed as a professional music therapist from
representing to the public that the individual may work with clients who have a
communication disorder and address communication skills.
(E) Beginning one year after October 3,
2023, no person shall knowingly provide music therapy services or use the title
"music therapist" or a similar title unless the person holds a valid
license issued under this chapter that is in good standing. Nothing may be
construed to prohibit or restrict the practice, services, or activities of any
person licensed, certified, or regulated under the laws of this state in
another profession or occupation from performing work, including the use of
music, incidental to the practice of their profession or occupation if that
person does not represent themself as a music therapist.
(F) This rule does not apply to members
of other professions licensed, certified, or registered by this state while
performing services within the recognized scope, standards, and ethics of their
respective professions.
