Rule 4758-17-02 | Active duty military, spouses and veterans.
(A) This rule utiliizes section 5903.01 of the Revised Code for defintions of armed forces, service member, merchant member, and veteran. This rule utlizes section 4743.041 of the Revised Code for definitions of active guard, military duty, and uniformed services.
(B) The board shall prioritize and expedite applications and record and track applications for veterans, an individual on active military duty, or the spouse of an individual on active military duty.
(C) The board shall issue a license or certificate to an individual or spouse of an individual on active military duty in this state as prescribed in section 4743.041 of the Revised Code.
(D) The board may require an active duty military or their spouse to provide the board with adequate documentation to meet all of the following:
(1) Application for a license or certificate from the board,
(2) Criminal records check as required under Chapter 4758. of the Revised Code and agency 4758 of the Administrative Code,
(3) Satisfactory evidence of the service member's active duty status in this state and documentation of the projected length of the active duty service,
(4) A copy of the active duty military member and spouse's marriage license,
(5) A copy of the license or certificate authorizing the spouse to provide services in alcohol or other drug prevention or treatment in another jurisdiction,
(6) The licensee or certificate holder's scope of practice in the jurisdiction where they are licensed or certified,
(7) The requirements which were in place in that jurisdiction at the time the license or certificate was issued,
(8) Other documentation as deemed reasonably necessary by the board.
(E) Unless otherwise prescribed in section 4743.041 of the Revised Code, the board shall:
(1) Determine an equivalent level of licensure or certification to issue,
(2) Award a license or certificate with an expiration date not to exceed the date of expiration on the jurisdictional license or certificate,
(3) If the license or certificate expires prior to the completion of the active military duty status, the license or certificate may be renewed with the board by one of the following methods:
(a) Providing documentation that the jurisdictional license or certificate has been renewed, or
(b) Renewing the certificate or license with the board by providing:
(i) The required number of continuing education hours on a pro-rated basis according to the amount of time the license or certificate was held, and
(ii) The license or certificate renewal application.
(F) The certificate or license returns to the board upon expiration of the active military duty status and as prescribed in section 4743.041 of the Revised Code.
(G) Licensees and certificate holders under this section must keep all information current with the board, including but not limited to, active duty, military or marital status.
