Rule 4729:8-4-03 | Access to opioid treatment program data provided by the Ohio department of mental health and addiction services.

 

(A) Pursuant to division (A)(23) of section 4729.80 of the Revised Code, the following persons shall be permitted to access opioid treatment program data provided by the Ohio department of mental health and addiction services in accordance with section 4729.772 of the Revised Code:

(1) Prescriber and prescriber delegates as authorized in division (A)(5) of section 4729.80 of the Revised Code;

(2) Pharmacist and pharmacist delegates as authorized in division (A)(6) of section 4729.80 of the Revised Code;

(3) The director of health as authorized in division (A)(13) of section 4729.80 of the Revised Code;

(4) An individual listed in division (A)(5) or (A)(6) of section 4729.80 who is from or participating with another state's prescription monitoring program; and

(5) A coroner, deputy coroner, or coroner's delegate as authorized in division (A)(17) of section 4729.80 of the Revised Code.

(B) Nothing in this rule shall be construed to limit the state board of pharmacy's access and use of data collected by the drug database to carry out its responsibilities in accordance with section 4729.81 of the Revised Code.
