Rule 4713-13-02 | Independent contractor.
Paragraphs (A) to (C) of this rule apply only to individuals licensed under Chapter 4713. of the Revised Code. Paragraph (D) of this rule applies to all licensees of the board.
(A) In accordance with section 4713.55 of the Revised Code, independent contractors will receive an independent contractor license that states the branch of cosmetology the holder is entitled to offer within a licensed salon or states the following, "independent contractors are entitled to offer within a licensed salon, cosmetology or any branch of cosmetology for which a current, valid practicing license is held."
(B) The fee for issuance of an independent contractor license under section 4713.55 of the Revised Code shall be seventy-five dollars. The fee for renewal shall be seventy dollars.
(C) An independent contractor shall have a current, valid license for the branch of cosmetology in which the applicant practices.
(D) The board shall hold independent contractors, including individuals holding individual barber shop licenses as required by division (C) of section 4709.09 of the Revised Code, and salon or barber shop owners responsible for compliance with all board statutes and rules as follows:
(1) The salon or barber shop owner is responsible for all common areas;
(2) Independent contractors are equally responsible for common areas when present; and
(3) Where the salon or barber shop has individual locked work areas, each independent contractor having the authority to use the individual work area shall be available or shall have an authorized representative be available to open the locked work area within an hour of the arrival of a board inspector for an inspection or investigation.
