Rule 4501:2-7-05 | Benefits.
(A) Each state highway patrol officer shall be entitled up to one thousand (1,000) hours of occupational injury leave with full pay for each injury incurred in the line of duty.
(B) Occupational injury leave shall not be used for absence occurring within seven calendar days of the injury. During that seven-calendar-day period, unused sick leave may be used for such absence.
(C) Each injury incurred in the line of duty which aggravates a previous existing injury, whether the previously existing injury was so incurred or not, shall be considered an independent injury.
(D) Each officer granted occupational injury leave by the superintendent shall not lose vacation, sick leave, personal leave, and service credit while receiving occupational injury leave benefits.
(E) A subsequent related absence that occurs after a return to work following a prior approved occupational injury leave will be considered as the same occupational injury claim.
(F) All occupational injury leave benefits must be approved by the superintendent of the Ohio state highway patrol pursuant to the provisions of section 5503.08 of the Revised Code and the rules promulgated in Chapter 5503. of the Revised Code. Decisions of the superintendent shall be final.
