Rule 4501-52-06 | Other inspections.
(A) Every bus subject to this chapter is also subject to roadside inspections conducted by employees of the state highway patrol. Roadside inspections include, but are not limited to, "end-route" inspections (such as at an amusement park or tourist attraction), post-crash inspections or any other inspection deemed by the state highway patrol as necessary to ensure the continued safe operation of a bus.
(B) Buses found in the following conditions are subject to removal of the official state highway patrol annual bus safety inspection decal:
(1) If the bus is in a condition that would prohibit further operation on a public highway by either normal operation or by towing by a wrecker in a driveaway-towaway operation.
(a) Driveaway-towaway operation means an operation in which an empty or unladen motor vehicle with one or more sets of wheels on the surface of the roadway is being transported:
(i) Between vehicle manufacturer's facilities;
(ii) Between a vehicle manufacturer and a dealership or purchaser;
(iii) Between a dealership, or other entity selling or leasing the vehicle, and a purchaser or lessee;
(iv) To a motor carrier's terminal or repair facility for the repair of disabling damage (damage which precludes departure of a motor vehicle from the scene of the accident in its usual manner in daylight after simple repairs including damage to motor vehicles that could have been driven, but would have been further damaged if so driven) following a crash;
(v) To a motor carrier's terminal or repair facility for repairs associated with the failure of a vehicle component or system; or
(vi) By means of a saddle-mount or tow-bar.
(b) Paragraph (B)(1) of this rule does not apply if the bus is placed entirely upon another vehicle for transportation to a repair facility.
(2) If the bus sustains disabling damage (damage which precludes departure of a motor vehicle from the scene of the accident in its usual manner in daylight after simple repairs, including damage to motor vehicles that could have been driven, but would have been further damaged if so driven) in a crash requiring towing from the crash scene either by wrecker in a driveaway-towaway operation or by being placed entirely upon another vehicle.
(3) If the bus is impounded by any law enforcement agency for any safety-related reason.
(C) No bus that has had the annual bus safety inspection decal removed as prescribed in paragraph (B) of this rule shall be placed into operation until all of the following conditions are met:
(1) It is in compliance with the requirements of this chapter;
(2) It is issued a valid official state highway patrol annual bus safety inspection report (driver vehicle inspection report) upon inspection by the state highway patrol;
(3) It is equipped with valid properly affixed state highway patrol annual bus safety inspection decals; and
(4) It is equipped with a valid properly affixed commercial vehicle safety alliance (CVSA) decal.
