Rule 3769-2-17 | Must furnish records.
(A) Every permit holder will, upon demand in writing by the commission, furnish the commission a full and complete statement of receipts, expenditures, attendance, and such other information as the commission might request with respect to any meeting, or with respect to any accounting period specified by the commission.
(B) Every commercial permit holder which does not own the real property at the place where a race meeting is to be conducted, at the time the application is filed for a permit, will file a copy of the current lease with the commission.
(C) The owner of the real estate will, at the time the application for a racing permit is filed by the lessee, provide the following to the commission:
(1) A current financial statement showing assets and liabilities;
(2) Its latest operating statement showing its income and expenses relating to the real estate;
(3) A list containing the names and addresses, and occupations of all officers, directors, owners, shareholders, or partners (both general and limited). In case of a corporation whose stock is publicly traded, this information need only be supplied as to all officers and directors, and those stockholders owning or controlling ten per cent or more of the stock of the corporation;
(4) Any other pertinent information requested by the commission. If any other corporation or partnership owns ten per cent or more of the stock of the corporate owner of the real estate, the corporation or partnership has to file the same information.
