Rule 3745-273-04 | Applicability- management standards for universal waste - mercury-containing equipment.

 

(A) Mercury-containing equipment covered under Chapter 3745-273 of the Administrative Code. The requirements of Chapter 3745-273 of the Administrative Code apply to persons managing mercury-containing equipment, as described in rule 3745-273-09 of the Administrative Code, except those listed in paragraph (B) of this rule.

(B) Mercury-containing equipment not covered under Chapter 3745-273 of the Administrative Code. The requirements of Chapter 3745-273 of the Administrative Code do not apply to persons managing the following mercury-containing equipment:

(1) Mercury-containing equipment that is not yet a waste under Chapter 3745-51 of the Administrative Code. Paragraph (C) of this rule describes when mercury-containing equipment becomes a waste.

(2) Mercury-containing equipment that is not a hazardous waste. Mercury-containing equipment is a hazardous waste if it exhibits one or more of the characteristics identified in rules 3745-51-20 to 3745-51-24 of the Administrative Code or is listed in rules 3745-51-30 to 3745-51-35 of the Administrative Code;

(3) Equipment and devices from which the mercury-containing components have been removed.

(C) Generation of universal waste - mercury-containing equipment.

(1) Used mercury-containing equipment becomes a waste on the date it is discarded.

(2) Unused mercury-containing equipment becomes a waste on the date the handler decides to discard it.
