Chapter 1501:47-9 | Muskingum Watershed Conservancy District

Rule 1501:47-9-01 | Horsepower limitations.
 

The following horsepower limitations apply to the below named waters of the Muskingum watershed conservancy district.

(A) "Horsepower" means the horsepower rating published by the manufacturer for the power unit involved and any power unit modified to reduce or increase the manufacturers rating is not to be operated on the waters of the district.

(B) It is unlawful for any person to operate a watercraft having a motor capacity in excess of ten horsepower on Beach City, Charles Mill, Clendening, Leesville, Piedmont and Wills Creek lakes.

(C) It is unlawful for any person to operate a watercraft with a motor in excess of twenty-five horsepower on Atwood lake.

(D) It is unlawful for any person to operate a watercraft with a motor in excess of three hundred ninety-nine horsepower on Tappan lake.

(E) It is unlawful for any person to operate a watercraft with a motor in excess of three hundred ninety-nine horsepower on Seneca lake.

Rule 1501:47-9-02 | Speed limitations.
 

It shall be unlawful for any person to operate or permit the operation of a watercraft at any time at a speed greater than idle speed or at a speed that creates a wake within an area zoned by the Muskingum watershed conservancy district and marked by buoys as a no-wake zone or designated as a shore zone. In areas which are not marked and designated as specific activity zones watercraft may be operated at such speed as is reasonable, having due regard to the traffic, surface and other existing conditions.

Rule 1501:47-9-03 | Sleeping on watercraft.
 

It is unlawful for any person to use any watercraft on the waters of the district for the purpose of sleeping on board unless such person has obtained a docking permit and the watercraft is anchored, tied, or otherwise secured in a designated area.

Rule 1501:47-9-04 | Intoxicating beverages.
 

(A) No person shall overtly and publicly consume or display the presence of any beer or intoxicating liquor, as defined in section 4301.01 of the Revised Code while occupying any watercraft upon the waters of Atwood lake, Beach City lake, Charles Mill lake, Clendening lake, Leesville lake, Pleasant Hill lake, Piedmont lake, Seneca lake, Tappan lake, or Wills Creek lake.

Rule 1501:47-9-05 | Launching, anchoring, and storage.
 

Ingress and egress for watercraft to the reservoirs of the district is only permitted at sites authorized by the district and no boats are authorized to be anchored, tied, or stored overnight at any points along the shores of the reservoirs unless under the terms of special contracts. Boats found unattended in violation of this regulation will be deemed "abandoned" and handled as provided in section 1547.30 of the Revised Code providing for the disposition of "abandoned" watercraft.

The operation of seaplanes, hovercraft, and submersibles is unlawful on any waters of the district.

Rule 1501:47-9-08 | Night speed activities.
 

It is unlawful for any person to operate or permit to be operated a watercraft at a speed in excess of six miles per hour, or to engage in water skiing, surfboarding, or other like towing activities on any waters of the Muskingum watershed conservancy district from sunset to sunrise local time.

Rule 1501:47-9-09 | Administrative permits.
 

The chief executive officer of the Muskingum watershed conservancy district, or his/her designee, may, if he/she determines that the public safety will be adequately protected, grant written permission for over-horsepower watercraft operation(s) on Muskingum watershed conservancy district controlled waterways under the conditions described in this rule. Such a permit may be issued to safety, fire department, law enforcement, and marina maintenance personnel, for law enforcement, training, rescue, salvage, testing, and maintenance activities when necessary for safe and efficient operations. Said officer may issue such permits for houseboats and commercial passenger carrying watercraft when it is determined that greater horsepower is necessary for safe operations due to the size, shape, and weight of the watercraft.

No person, while being towed by a watercraft, is permitted to use any device for the purpose of becoming airborne over Muskingum watershed conservancy district waters. No person while operating a watercraft is permitted to tow any person using a device for the purpose of becoming airborne over the muskingum watershed conservancy district waters.
